Terms of Service
By accessing this website and/or purchasing products from Designed By Moran, you agree to be bound by these Terms of Service in their entirety. If you do not agree, you must discontinue use of this website and refrain from placing any order.
By placing an order, you confirm that you are at least 18 years of age and are legally capable of entering into a binding contract.
Product Use & Responsibility
All products sold by Designed By Moran are intended for off-road, racing, performance, or custom vehicle applications unless otherwise stated. These products are not intended for use on public roads where prohibited by law.
The customer assumes full responsibility for proper installation, fitment verification, vehicle compatibility, tuning, maintenance, and safe operation of any purchased product. Professional installation by a qualified technician is strongly recommended.
Designed By Moran is not responsible for damages, failures, injuries, losses, labor costs, downtime, towing expenses, shipping delays, vehicle damage, engine damage, overheating, or any other issues resulting from improper installation, misuse, racing use, insufficient supporting modifications, tuning issues, or use outside of intended applications.
Compliance With Laws
The customer is solely responsible for ensuring compliance with all local, state, federal, and international laws applicable to the purchase, installation, and use of any product sold by Designed By Moran.
Designed By Moran makes no representation or warranty that any product is legal for use on public roads, highways, or emissions-controlled vehicles in every jurisdiction.
It is the customer's responsibility to determine whether a product complies with applicable emissions, smog, tampering, inspection, registration, noise, safety, or other legal requirements prior to purchase or installation.
Fitment & Vehicle Modifications
Many products are designed for modified or performance-oriented vehicles. Vehicle modifications, aftermarket components, production variances, previous repairs, accident history, fabrication differences, and installer methods may all affect fitment.
Minor trimming, adjustment, fabrication, or modification may be required depending on individual vehicle configuration. The customer is solely responsible for confirming compatibility prior to purchase. Designed By Moran is not responsible for fitment issues resulting from undisclosed vehicle modifications or non-standard configurations.
Order Processing & Lead Times
Many products are built-to-order and are fabricated, coated, assembled, or otherwise prepared after purchase. Estimated lead times and shipping dates are estimates only and are not guaranteed. Delays may occur due to supplier availability, coating schedules, freight carriers, manufacturing issues, material shortages, or circumstances beyond our control.
Chargebacks, payment disputes, or cancellation requests filed solely on the basis of production lead times or shipping delays are not considered valid grounds for dispute and may be contested using the customer's acceptance of these Terms of Service and all related store policies.
Force Majeure
Designed By Moran shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, weather events, labor shortages, supplier delays, freight interruptions, manufacturing disruptions, equipment failures, government actions, tariffs, material shortages, power outages, cybersecurity incidents or system outages, or carrier delays.
Pricing & Availability
Prices, specifications, availability, materials, product design, and product configurations are subject to change without notice. Designed By Moran reserves the right to cancel or refuse any order at its sole discretion, including but not limited to cases involving pricing errors, suspected fraud, inventory limitations, or shipping restrictions. In the event an order is cancelled by Designed By Moran, the customer will receive a full refund of any amount paid.
Returns, Refunds & Cancellations
All sales are subject to our Refund & Return Policy, which is incorporated into these Terms of Service by reference. By placing an order, the customer acknowledges that returns, refunds, exchanges, and cancellations are subject to the terms and conditions outlined in that policy and are granted solely at the discretion of Designed By Moran.
Shipping & International Orders
The customer is responsible for providing accurate and complete shipping information at the time of purchase. Designed By Moran is not liable for delays or losses resulting from inaccurate shipping details provided by the customer.
International customers are solely responsible for all import duties, taxes, VAT, brokerage fees, customs charges, or any additional fees imposed by their country or carrier. Designed By Moran is not responsible for customs delays, customs holds, import restrictions, seized shipments, or any additional costs associated with international delivery.
Electronic Communications
By placing an order or communicating with Designed By Moran electronically, the customer agrees to receive communications electronically, including order confirmations, invoices, updates, notifications, and policy-related communications. All electronic communications will be delivered to the email address provided at the time of purchase, which the customer confirms is accurate and actively monitored.
Electronic communications shall satisfy any legal requirement that such communications be provided in writing, and shall be considered received upon transmission to the provided email address.
Warranty Disclaimer
All products are provided "as-is" and "as-available" without warranty of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.
Designed By Moran does not warrant that products will meet every individual customer's requirements, be free from defects, or be suitable for any specific application beyond their stated intended use.
Limitation of Liability
To the maximum extent permitted by applicable law, Designed By Moran shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages of any kind arising from the purchase or use of our products or website, even if advised of the possibility of such damages.
Maximum liability for any claim relating to a purchased product shall not exceed the original purchase price paid by the customer for that specific product.
Indemnification
By purchasing from or using this website, you agree to indemnify, defend, and hold harmless Designed By Moran, its owners, employees, contractors, and representatives from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising out of or related to your use of our products, your breach of these Terms of Service, or your violation of any applicable law or third-party right.
Intellectual Property & Product Design Protection
All product designs, fabrication methods, CAD models, engineering concepts, photographs, renderings, branding, logos, website content, product configurations, and proprietary design elements associated with Designed By Moran are protected intellectual property.
No such materials may be copied, reproduced, replicated, reverse engineered for commercial purposes, distributed, manufactured, modified for resale, or used to create derivative products without prior written consent from Designed By Moran.
Unauthorized reproduction, commercial manufacturing, resale, or distribution of Designed By Moran products or proprietary designs may result in legal action. Violators may be held liable for damages including lost profits, unjust enrichment, statutory damages where applicable, attorney's fees, court costs, investigative costs, injunctive relief, and all other remedies available under applicable law.
By purchasing from this website, the customer acknowledges that Designed By Moran retains all intellectual property rights related to its products, designs, engineering, branding, and associated materials.
Governing Law & Venue
These Terms of Service shall be governed exclusively by the laws of the State of Arizona, without regard to conflict of law principles. Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and both parties consent to personal jurisdiction in such courts.
Severability
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
Entire Agreement
These Terms of Service, together with our Refund & Return Policy, Shipping Policy, and Legal Notice, constitute the entire agreement between the customer and Designed By Moran with respect to the use of this website and the purchase of products. They supersede all prior communications, representations, or agreements, whether written or oral.
Policy Acceptance
By accessing this website or placing an order, the customer confirms they have read, understood, and agreed to these Terms of Service and all related store policies, including the Refund & Return Policy, Shipping Policy, and Legal Notice published on this website.
